TERMS AND CONDITIONS OF USE FOR THE WEBSITE

The website www.substipharm.com (hereinafter the “‘Website”‘) provides Users with information about Substipharm and contact forms and addresses so they can get in touch with Substipharm. 

 

1. Definitions

Content: means all the elements constitutingEverything that makes up the information on the Website, in particular, text – images – videos.

User: means aAn Internet user who logs on to and uses the aforementioned Website.

Website or Site: means the Substipharm’s website www.substipharm.com website

The Website www.substipharm.com (hereinafter the ‘Website’) provides Users with information about Substipharm and contact forms and addresses so they can get in touch with Substipharm. 

The terms “‘personal data”‘, “‘data subject”‘, “identified or identifiable natural person”, ‘”data processor”‘ and “‘sensitive data”‘ have the meanings defined by Regulation (EU) 2016/679 of the European Parliament (“GDPR“) and of the Council of 27 April 2016 and the French Data Protection Act updated to 1 June 2019. 

 

2. Presentation of the Website 

Pursuant to Article 6 of French Act no. 2004-575 of 21 June 2004 on confidence in the digital economy, Users of the www.substipharm.com Website are informed of the identity of the various parties involved in the creation and monitoring of the Ssite.

Use of the www.substipharm.com Website implies full acceptance of the terms and conditions of use described below. These terms of use, the legal notices and the rules for collecting and processing personal data may be amended or supplemented at any time. They are nevertheless binding on the User, who is advised to refer to them as often as possible in order to ensure familiarity with them.

This Website is normally accessible to Users at all times. However, www.substipharm.com may decide to make the Website unavailable in order to carry out technical maintenance on it, in which case it will endeavour to inform Users of the dates and times of such maintenance work in advance.

 

4. Intellectual property and infringement

The Website and its content constitute an intellectual work protected by the provisions of the French Intellectual Property Code and applicable International Laws. It is owned and operated by Substipharm, which owns the intellectual property rights and holds the rights to use all the content on the Website, including text, images, graphics, logos, videos, icons and sounds.

The User may not in any way reuse, transfer or exploit for ittheir  own account all or part of the content or works on the Website.

It is forbidden to reproduce, represent, modify, publish or adapt all or part of the Website’s content, by whatever means or process, without the prior written consent of Substipharm. 

Any unauthorised use of the Website or of any of its content will be considered an infringement and will be prosecuted in accordance with the provisions of Articles L.335-2 et seq. of the French Intellectual Property Code.

 

5. Disclaimer

Substipharm acts as publisher of the Website. Substipharm is responsible for the quality and accuracy of the Content it publishes.

Substipharm cannot be held liable for any direct or consequential damage caused to the User’s hardware when accessing the Website resulting either from the use of hardware that does not meet the specifications indicated in section 7 or from the occurrence of a bug or incompatibility.

In the same way, Substipharm cannot be held liable for consequential damage, indirect damage, or incidental damage such as loss of business or loss of opportunity resulting from use of the www.substipharm.com Website.

 

6. Description of services provided

6.1. Information about the Company

The purpose of the www.substipharm.com Website is to provide information about all the Company’s activities, and to pick up quality complaints, pharmacovigilance cases, requests for medical information, applications for employment with the Company, and commercial requests.

Substipharm endeavours to provide information on the Website that is as accurate as possible. However, it cannot be held responsible for any omissions, inaccuracies or shortcomings in updating, whether these are its fault or the fault of third-party partners who provide it with this information.

All information on the Website is given for information purposes only and is subject to change. Furthermore, the information on the Website is not exhaustive. It is given subject to modifications having been made since it was put online.

 

6.2. Careers contact forms

The Website features a ‘ “Join Us“’ section in which Users can view Substipharm’s job and internship offers and send their CV and covering letter via the online application form. 

These documents are collected solely in the context of Substipharm recruitment, for the purposes of processing applications, contacting candidates and filling vacancies, this purpose being considered the legal basis for processing the data contained in the documents. By sending their Curriculum Vitae and covering letter via the online application form, the User is informed that their details will be kept and used for this purpose on the Website and by Substipharm staff involved in the recruitment process, and only for the time necessary. In any event, such information will be destroyed after a period of two years following receipt, unless the User requests early deletion.

 

6.3. Business contact forms

The Website includes a “’Business, Marketing, Other“’ section in which Users may submit commercial requests.

 

6.4. Dedicated pages for medical information requests, pharmacovigilance cases and quality complaints 

The Website has pages giving users the e-mail addresses for contacting Substipharm with requests concerning: 

– Medical information, 

– Pharmacovigilance cases,

– Quality complaints.  

The information and personal data that may pass through the e-mail addresses are not stored on the website.

 

6.5. Sensitive Data and Health-related Information: 

For all medical information, quality complaints or reports of pharmacovigilance, Users are invited to use the e-mail addresses specifically provided for this purpose. 

The Website has a page for messages sent by Users via the e-mail addresses given on the ‘CONTACTS’ page of the Website. 

The information and personal data that passes through the addresses substipharm@vigipharm.fr; qadistribution@substipharm.com; substipharmita@gbpharma.it; customer-italy@substipharm.com; substipharm@productlife-group.com reaches the Substipharm staff or the service providers in charge of processing User requests or notifications. It is not stored on the website. 

By sending information via these e-mail addresses, the User is informed that their personal data will be used for the sole purpose of processing requests or notifications sent to Substipharm, and only for this purpose. 

Personal data is stored securely in Substipharm’s computer network. Substipharm implements all necessary technical and organisational means to protect personal data, and Users can access it under the conditions set out in section 8 below. 

Substipharm has taken the necessary security measures to prevent the loss, misappropriation or damage to the integrity of the data under its control, but does not give any total guarantee against such damage.

7. Contractual limitations on technical data

The Website uses JavaScript technology.

Substipharm cannot be held liable for any damage to property linked to use of the Website. Furthermore, the User of the Website agrees to access the Website using modern, virus-free hardware and an up-to-date web browser.

The Website is hosted by a service provider in the European Union in accordance with the provisions of the GDPR. 

The aim is to provide a service that ensures the best possible level of accessibility. The host ensures the continuity of its service 24 hours a day, every day of the year. However, it reserves the right to interrupt the hosting service for the shortest possible period of time, in particular for maintenance purposes, to improve its infrastructure, in the event of infrastructure failure or if the Services generate traffic deemed to be abnormal.

Substipharm and the host cannot be held liable in the event of Internet network malfunction, in particular network congestion preventing access to the server.

 

8. Management of personal data

The User is informed of the regulations governing marketing communications, the Act of 21 June 2014 on Confidence in the Digital Economy, the Data Protection Act as amended on 1 June 2019 and the GDPR.

 

8.1. Persons or entities responsible for the collection of Personal Data

The person responsible for the processing of the User’s Personal Data collected while browsing the Website is: Substipharm, represented by its Chairman, and legal representative, Mr Léopold Berthier.

As the controller of the data it collects, Substipharm undertakes to comply with the legal provisions in force. 

 

8.2. Conditions for collecting and processing the data collected

Substipharm may process browsing and IP address information to :

9. Incident notification

Whatever efforts are made, no method of transmission over the Internet and no method of electronic storage is completely secure. Consequently, Substipharm cannot guarantee absolute security.

If Substipharm becomes aware of a breach of security, the Users affected will be notified so that they can take appropriate action. Substipharm’s incident notification procedures take into account all its legal obligations, at both national and European level. 

To ensure the security and confidentiality of Personal Data, Substipharm uses networks protected by standard measures such as firewalls, pseudonymisation, encryption and passwords. When processing Personal Data, Substipharm takes all reasonable measures to protect it against loss, misuse, unauthorised access, disclosure, alteration or destruction.

 

10. jurisdiction

Any dispute relating to use of the www.substipharm.com Website shall be governed by French law. Except in cases where the law does not permit, exclusive jurisdiction is given to the competent courts of Paris.
